On May 13, USDA-APHIS proposed lifting the restrictions on the interstate movement of Berberis thunbergii varieties ‘Della’ and ‘O’ Byrne’ and Mahonia x media variety ‘Lionel Fortescue’. These three varieties were thoroughly evaluated by the USDA’s Agricultural Research Service at the Cereal Disease Laboratory in St. Paul, MN and found to be resistant to Black Stem Rust (Puccinia graminis).

If you have not yet responded to USDA’s Census of Agriculture, please do so before May 31. “Every time we go to Capitol Hill or meet with USDA representatives,” says Marvin Miller, Ph.D., AAF, Ball Horticultural Company, West Chicago, Illinois, chairman of both SAF’s and OFA’s government relations committees, “we cite statistics from the USDA census, which prove how important our industry is as a leader in U.S. agriculture. This will be the document folks will refer to for five years when we compare our green industry to the rest of agriculture.”

On May 6th, ANLA submitted comments to USDA-APHIS in support of updating the Imported Fire Ant (IFA) treatment manual. A recent environmental assessment conducted by USDA-APHIS, in collaboration with the University of Tennessee, identified additional practices for treating balled-and-burlapped nursery stock and grass sod that were effective in preventing IFA from being transported outside of regulated areas. The research also describes how B&B drenches can be done in a manner that would reduce the number of necessary pesticide applications and the quantity of the pesticide used.

The USDA-APHIS recently announced a final decision on a list of propagative plants that will not be permitted for import under the Not Authorized Pending Pest Risk Analysis (NAPPRA) rule. The prohibited plant lists go into effect May 20, 2013 and include 31 taxa of plants for planting that were determined by the agency to be of potential invasive weed concern and 107 taxa of plants for planting that were identified to potentially carry invasive pests and/or diseases of significant concern from foreign countries to the US. The plants included on this NAPPRA list were initially made public in the fall of 2011 and included a 90-day comment period.

With multiple ongoing lawsuits and congressional interventions, the situation surrounding H-2B and prevailing wage rules remains a complicated and muddied affair. In response to a recent court order, the U.S. Citizenship and Immigration Services (USCIS) has suspended the processing of Form I-129 H-2B petitions (announcement attached below).
