On May 9, the Senate Judiciary Committee takes up S.744, the Border Security, Economic Opportunity, and Immigration Modernization Act of 2013. The bill, a product of months of careful bipartisan negotiation, seeks to establish a 21st Century immigration system worthy of the United States of America. It is a lengthy and detailed bill covering border security, future legal immigration, expanded visa programs for industries ranging from agriculture to high tech, and a tough but fair process for unauthorized immigrants to earn legal status over time.

DOL cannot currently implement its H-2B program rule due to a preliminary injunction issued last year by a federal judge in the Northern District of Florida. On April 1st, the 11th Circuit Court of Appeals affirmed the injunction decision reached in the Northern District of Florida. This is a great decision for H-2B employers and ANLA would like to thank the law firms of Greenberg Traurig and CJ-Lake for all their work on the litigation.

On April 17th, the Senate “Gang of Eight” introduced its comprehensive immigration reform legislation entitled, “Border Security, Economic Opportunity, and Immigration Modernization Act of 2013. The legislation includes provisions on border security; the creation of a new “W-Visa” program for jobs in industries like hospitality, construction, and food processing; a new agricultural worker program, a mandatory E-verify system, changes to the existing H-2B Program; and a broad legalization of unauthorized immigrants.

ANLA is hard at work preparing for the coming push for an historic modernization of our nation’s immigration system. In just the last week, ANLA’s government relations professional staff were a presenter at a Senate staff briefing on the agricultural provisions of the bill, provided a telephonic briefing of state agriculture secretaries, commissioners, and directors, and met with the editorial board of the Washington Post to discuss the case and outlook for reform legislation.

The U.S. Senate Judiciary Committee held a marathon immigration hearing on Monday, April 22. The four-panel hearing featured witnesses representing agriculture, general business, high tech, law enforcement, faith, and other perspectives generally in support of modernizing America's immigration system. A small number of reform opponents were also on the witness list. Speaking to a mostly sympathetic Chairman Patrick Leahy (D-VT) and committee members, each of these witnesses voiced support for the agricultural provisions of S.744, the Border Security, Economic Opportunity, and Immigration Modernization Act.
