U.S. Citizenship and Immigration Services (USCIS) recently published a revised Employment Eligibility Verification Form I-9. After May 7, 2013, employers must only use Form I-9 (Rev. 03/08/13)N for new hires. Failure to do so may result in fines.

Recently, OSHA published a fact sheet regarding new requirements for their Hazard Communication Standard. The changes bring the OSHA standard in line with the Globally Harmonized System of Classification and Labeling of Chemicals (GHS) standard. Many of the changes impact chemical producers, however, employers will need to address the aspects pertaining to training, workplace labeling and hazard communication as necessary. On January 25, the United States Court of Appeals for the District of Columbia ruled in Noel Canning v. National Labor Relations Board (NLRB) that President Obama violated the Constitution when he bypassed the Senate to fill NLRB vacancies with Democrats Sharon Block and Richard Griffin.

Last Friday, a federal district court in South Carolina struck down the National Labor Relations Board’s ( NLRB) unionization rights notice posting rule in response to a challenge by the US Chamber of Commerce. The court held that the NLRB does not have the authority to require employers post the notice. This week, a federal appellate court has granted plaintiffs’ request for an injunction, delaying the effective date in this matter until the Court has a chance to hear arguments and issue a ruling. Effectively, this means that the earliest this rule could go into effect would be sometime around November or December.
